These Terms of Service (“Terms”) govern your access to and use of Impex Trading, operated by Impex Trading(“we,” “us,” or “our”), including our website at https://impextrading.caand related applications (the “Service”). By creating an account or using the Service, you agree to these Terms.
1. Educational purpose only
Impex Trading is an education and simulation platform. It does not provide investment, tax, or legal advice. Nothing on the Service is a recommendation to buy, sell, or hold any security or options contract.
The Service does not connect to brokers, execute trades, or manage real money on your behalf. Portfolio and screener features are for modeling, learning, and tracking purposes only. You are solely responsible for your investment decisions and for consulting qualified professionals as needed.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that your use complies with applicable laws.
3. Accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at support@impextrading.com if you suspect unauthorized access.
We may suspend or terminate accounts that violate these Terms, pose security risks, or are used for abusive or unlawful activity.
4. Subscriptions and billing
We offer free and paid plans. Current paid tiers include Plus ($34.99/month) and Pro ($49.99/month). Features available on each plan are described on our Pricing page and may change over time.
When billing is enabled, paid subscriptions are processed by Stripe. By subscribing, you authorize recurring charges according to the plan you select. You can manage or cancel a subscription through the billing portal where available. Fees are generally non-refundable except where required by law or explicitly stated at checkout.
We may change prices or plan features with reasonable notice. Changes typically apply at your next renewal after notice is provided.
5. Acceptable use
You agree not to:
- Use the Service for unlawful purposes or in violation of these Terms
- Attempt to gain unauthorized access to accounts, systems, or data
- Scrape, crawl, or bulk-export content except through features we explicitly provide
- Circumvent access controls, subscription limits, or security measures
- Reverse engineer, decompile, or misuse the Service except where permitted by law
- Upload malware or interfere with the Service's operation
- Misrepresent affiliation with us or use the Service to provide regulated financial advice to others
6. Intellectual property
The Service, including its software, design, text, graphics, and educational content, is owned by us or our licensors and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial educational purposes in accordance with these Terms.
You retain ownership of data you enter (such as portfolio positions). You grant us a license to host, process, and display that data solely to operate the Service for you.
7. Third-party services and data
The Service may display market data, news, or screener results from third parties. That content is provided for informational purposes, may be delayed or inaccurate, and remains subject to third-party terms. We are not responsible for third-party services linked from or integrated with the Service.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or that calculations, probabilities, screeners, or performance history will be accurate or suitable for any trading decision. Options trading involves substantial risk and is not suitable for all investors.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON ITS CONTENT — INCLUDING TRADING LOSSES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $100.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.
10. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends, but sections that by their nature should survive (such as disclaimers, limitations of liability, and indemnification) will survive.
12. Changes
We may modify these Terms from time to time. We will post the updated Terms on this page and update the effective date. Continued use after changes become effective constitutes acceptance of the revised Terms. Material changes may also be communicated by email or in-product notice.
13. Governing law
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your jurisdiction apply.
